​​Direct City Administrator to approve Portland-Gresham Urban Services Intergovernmental Agreement

​ ​ The City of Portland ordains. ​ ​ Section 1. The Council finds: ​ ​ ​ Oregon's Statewide Planning Goal 2 requires that adjacent, and nearly adjacent, comprehensive plans be coordinated with one another. ​ Oregon Revised Statutes, Chapter 195, provides for coordination agreements that assign unincorporated land between nearly adjacent cities to one city or another for future service provision . ​ ​ Both Cities have interagency agreements with Multnomah County under the former ORS 197.190 describing either an urban service area or an urban growth management area; and there are inconsistencies between these existing agreements, with some unincorporated areas assigned to both Cites while other areas are assigned to neither city. ​ In 2001, the City of Portland and Multnomah County adopted an intergovernmental agreement via Ordinance 51712 to transfer land use planning responsibilities to the City of Portland within identified Urban Pockets. ​ ​ An updated intergovernmental agreement between the City of Portland, City of Gresham, and Multnomah County is needed to reflect amendments to the USB and coordinate the orderly provision of urban services. ​ Both Cities wish to memorialize their cooperation in an intergovernmental agreement that provides for continued coordination as both cities carry out their updated plans. The intergovernmental agreement is attached as Exhibit A of this ordinance. ​ ​ NOW, THEREFORE, the Council directs: ​ ​ ​ The City Administrator shall sign the intergovernmental agreement on behalf of the City Council. ​ The effective date of the ordinance shall be October 1, 2026, in anticipation of the adoption of the intergovernmental agreement by the City of Gresham and Multnomah County.
