The City of Portland ordains. Section 1. The Council finds: The City and Laborers’ International Union of North America, Local 483 – Recreation (LiUNA-Rec) are parties to a collective bargaining agreement (CBA) effective July 1, 2022, to September 30, 2026. Schedule C of the CBA defines the applicability of the CBA for employees working in the Recreation Associate Classification. Item 25 of Schedule C of the CBA states, “Wage Scales – Applies. Employees shall earn the wage outlined below. Employees working in a Lead Counselor or Lead Event Host role shall receive a Leadership premium of $2.00 per hour while performing that body of work that requires direction and coaching of other Recreation Support Staff. Employees in Aquatics with a dual certification (swim instruction and life guarding) shall receive a premium of $2.00 per hour when performing that body of work. No pyramiding of these premiums is allowed.” Previously, the Adaptive Recreation and Lifelong Recreation programs assigned two Lead Counselors and two additional staff to increase the ratio of staff to attendees to 1:4 for trip excursions. Moving forward, Trip Leaders will only have additional staff if participants request Inclusion Support. Furthermore, some participants bring their own aide or support person that is not an employee of the City . This change would make the Lead Counselors leading trip excursions ineligible for the premium pay based on the CBA. There is an interest in continueing this premium for Trip Leaders. NOW, THEREFORE, the Council directs: The Director of the Bureau of Human Resources is authorized to enter into a Letter of Agreement between the City and LiUNA-Rec in a form substantially similar to Exhibit A to amend the language in Item 25 of Schedule C to include Recreation Associates leading trip excursions with Adaptive and Lifelong Recreation. This ordinance is binding City policy. Section 2. The Council declares that an emergency exists because delay would negatively impact the ability to ensure that staff are paid correctly for responsibilities while on trip excursions for the Portland Parks Bureau; therefore, this Ordinance shall be in full force and effect after its passage by the Council.
