*Appropriate grant for $602,650 from U.S. Department of Energy for energy efficient improvements at Charles Jordan Community Center

The City of Portland ordains: Section 1. The Council finds: Portland Parks & Recreation applied to U.S. Department of Energy for a grant in the amount of $602,650 for energy efficiency heating, ventilation, and air-conditioning improvements at Charles Jordan Community Center on January 31, 2024. U.S. Department of Energy has notified the City of Portland that it will award a grant for the energy efficiency heating, ventilation, and air conditioning-improvements at Charles Jordan Community Center to Portland Parks & Recreation in the amount of $602,650. The grant period is from August 1, 2024 to July 31, 2026. Exhibit A is the Grant Agreement. On April 5, 2017, City Council authorized a competitive solicitation per City Code 5.34.880 for an Energy Savings Performance Contract (ESPC) (Ordinance No. 188310). On September 4, 2019, City Council accepted the Guaranteed Maximum Price for Stage 1 (GMP1) implementation of the ESPC. On November 20, 2019, the City entered into contract agreement with McKinstry Essention, LLC (Contract No. 30007025). Portland City Council adopted Ordinance 191222 on April 5, 2023 to amend contract with McKinstry Essention, LLC for energy savings performance contracting services not to exceed $18,500,000 (Contract 30007025). Included in the adopted Ordinance 191222 is this anticipated grant funding and scope of work to “modernize the heating, ventilation, and air-conditioning system at Charles Jordan Community Center.” NOW, THEREFORE, the Council directs: The FY 2024-25 budget is hereby amended as follows: GRANTS FUND Fund 217 Business Area – PK Bureau Program Expenses – $602,650 Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
