*Authorize a Co-Location Agreement for $65,497 with TriMet for a sublease for co-location of data radio equipment at Mt. Scott

The City of Portland ordains: Section 1. The Council finds: Tri-County Metropolitan District of Oregon (Tri-Met) has the legal right of possession of approximately 2,500 square feet of space situated on the property commonly known as Mt. Scott in Clackamas County, Oregon. Tri-Met operates a mobile radio service facility at this location. Portland Water Bureau operates and maintains data radio equipment for Supervisory Control and Data Acquisition (SCADA) communications at the Mt. Scott location. This radio equipment is essential for Portland Water Bureau monitoring and control of critical facilities throughout the Portland metropolitan area. The site provides secured space, utility and emergency power, climate control for Portland Water Bureau radio equipment, and allows access to the facility twenty-four hours a day; seven days a week. Portland Water Bureau will enter into a Co-Location Agreement (Agreement) with Tri-Met to utilize a portion of the Tri-Met telecommunications site for the sublease for the co-location of radio equipment. The Agreement grants Portland Water Bureau the right to maintain and operate a telecommunication facility and the equipment on the property. The total cost of the Agreement is $65,497. Funding of $12,337 is available in the FY 2024-25 Budget and additional funds of $53,160 will be requested in FY 2025-26 through FY 2028-29 Budgets. The cost for each subsequent fiscal year may fluctuate; however, the total cost will not exceed the amount of $65,497 for the term of the Agreement. NOW, THEREFORE, the Council directs: That the Portland Water Bureau Director is authorized to execute on behalf of the City a Co-Location Agreement with Tri-Met in a form in accordance with the Agreement attached as Exhibit A. The Mayor and Auditor are hereby authorized to draw and deliver checks chargeable to the Water Fund when demand is presented and approved by the proper authorities. Amendments increasing the total compensation of the Agreement may be agreed to and executed by the Portland Water Bureau Director or their designated representative for up to twenty-five percent of the total Agreement amount. Any increase exceeding twenty-five percent of the total compensation would need Council approval. Section 2. The Council declares that an emergency exists in order that the Agreement may occur without delay; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
