*Accept grant for $1,588,849 from Oregon Department of Transportation and authorize Intergovernmental Agreement for Portland Local Traffic Signal Controller Replacement Phase 2

The City of Portland ordains: Section 1. The Council finds: On January 4, 2023, Portland City Council passed Ordinance 191121 authorizing Portland Bureau of Transportation (PBOT) to submit applications to Metro for Transportation System Management & Operations Program grants to fund five Intelligent Transportation System (ITS) projects for $8,200,000; and One of the five ITS project grant application submittals by PBOT to Metro was for Local Traffic Signal Controller Replacement Phase 2 in the amount of $1,588,849; and Metro has notified the City of Portland that it will award a grant for Local Traffic Signal Controller Replacement Phase 2 in the amount of $1,588,849; and The Local Traffic Signal Controller Replacement Phase 2 includes purchasing Advanced Transportation Controllers (ATCs, hardware and software) and converting the existing traffic signal timing at 239 traffic signals in collaboration with the City of Gresham; and The grant number is TR000372 and Federal Project key number is KN23584; and Local match in the amount of $116,385 will be provided by PBOT (accounted for in the Build Portland funds) and $65,466 by City of Gresham; and This project was selected as part of the Transportation System Management and Operations (TSMO) Program and may include a combination of federal, state, and local funds; and The Oregon Department of Transportation (ODOT) has determined that the City of Portland is eligible for state and federal funds for the work to be performed under the attached agreement (Exhibit A). The parties enter into the attached Agreement to exchange these funds, identify the Project that will be funded with the state and federal funds, and describe the method State will use to reimburse Agency for work performed on the Project using the state and federal funds, including establishing invoicing requirements and the proportional reimbursement rate; and Federal funds for this project total and are limited to $1,588,849. NOW, THEREFORE, the Council directs: The Deputy City Administrator is hereby authorized to accept on behalf of the City of Portland a grant from ODOT for Local Traffic Signal Controller Replacement Phase 2 in the amount of $1,588,849. The Deputy City Administrator or Bureau Director is authorized to execute Agreement in the amount of $1,588,849 in a form similar to the contract attached as Exhibit A. The Deputy City Administrator or Bureau Director is authorized to execute contracts, grants, intergovernmental agreements, and amendments, approved as to be the City Attorney, to the scope of services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty-five percent (25%) or greater. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Deputy City Administrator’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
