Purpose & background

The City of Portland’s public trash can collection program services approximately 400 trash cans in Downtown Portland, once a day, 7 days per week. Republic Services currently provides this collection service, using a price agreement put in place in 2015. This agreement has reached its renewal limit, so the Bureau of Planning and Sustainability requires an RFP to create a new price agreement with one to two qualified vendors. This ordinance does not change any existing City policies.

Financial impacts

As the costs related to trash collection, such as labor, vehicles, and materials, have increased, we anticipate an increase in the cost of the services to be provided in the collection agreements. These costs are included in the Solid Waste Management Fund, which pays for this work, and are part of the BPS 5-year forecast. The Solid Waste Management Fund is funded by a per-ton fee on commercial solid waste collection within the City of Portland, as well as an 8% franchise fee on residential haulers. Both these fees were recently increased to pay for projected increased costs, including public trash collection costs. This ordinance does not change any current or future staffing levels.

There will not be any community impacts or community involvement with this RFP. The RFP is needed to maintain current service levels.

The City of Portland ordains: Section 1. The Council finds: The Bureau of Planning and Sustainability (BPS) utilizes private waste collection companies to collect trash regularly from public trash cans located in Downtown Portland once per day, 7 days per week. The current price agreement utilized by BPS for collection of public trash cans located in Downtown Portland expires on April 30, 2025. The Bureau seeks City Council’s authorization for Procurement Services to issue a competitive solicitation and issue price agreements for the public trash collection services described above. The estimated average annual cost is $2,000,000, for a total not-to-exceed amount of $10,000,000 over five years. Funds will be made available as needed in the Bureau of Planning and Sustainability, Solid Waste Management Fund budget over the term of the contract (Cost Center PNSD000006 ). NOW, THEREFORE, the Council directs: The Chief Procurement Officer is authorized to conduct a competitive solicitation process in accordance with Chapter 5.33 of the Portland City Code and to negotiate contracts with the selected successful proposers. Upon Council’s acceptance of the Chief Procurement Officer’s Report pursuant to Portland City Code Subsection 5.33.040.A.4, the Chief Procurement Officer is authorized to execute up to two price agreements with a cumulative amount not-to-exceed $10,000,000, provided the price agreements have been approved as to form by the City Attorney’s office. The Mayor and Auditor are hereby authorized to pay for the price agreements from the Solid Waste Management Fund Budget when demand is presented and approved by the proper authority. Section 2. The Council declares that an emergency exists due to the urgent need to ensure uninterrupted collection of public trash cans in Downtown Portland; therefore, this Ordinance will be in full force and effect from and after its passage by the Council.
