The Bureau of Transportation (PBOT) requires professional services to support ongoing needs of the Transportation Capital Improvement Program. PBOT does not have staff qualified to accomplish the environmental work required for federally funded projects. The proposed ordinance does not change any current City policies. The selection of consultants will be conducted through a QBS (Qualifications Based Selection) process where the most qualified firms received the highest scores and Task Orders will be issued on a rotational basis.

Financial impacts

PBOT anticipates awarding multiple price agreement contracts with a cumulative amount not to exceed $2,500,000 over five-year terms for all price agreements. Funding is identified by project in the PBOT Capital Improvement Plan budget for the necessary Task Orders.

The City of Portland ordains: Section 1. The Council finds: The Bureau of Transportation (PBOT) requires professional services to support implementation of the Transportation Capital Improvement Program. PBOT does not have qualified staff needed to conduct environmental assessments for federally funded projects. The establishment of on-call services contracts based on estimated amounts of work without specific City commitment to purchase any given amount of service is in the best interest of the City. On-call services contracts save time and money by reducing repetitive solicitation processes on a project-by-project basis. PBOT will advertise and solicit for services through a Qualifications Based Selection (OBS) process through a Request for Proposal in accordance with Chapter 5.68 of the City Code for the purpose of entering into these on-call services contracts. An evaluation committee will evaluate all consultant proposals and review proposals against defined performance criteria. Services needed for specific projects will be defined, authorized, assigned and approved for a not-to-exceed dollar value at the discretion of PBOT via negotiated Task Orders. Task Orders will be negotiated with the selected firms on a rotational basis. The Bureau of Transportation has funds budgeted in FY 2024 and proposed FY 2025 for the projects that will utilize these on-call price agreements. NOW, THEREFORE, the Council directs: The Chief Procurement Officer is authorized to facilitate the Qualifications Based Selection (OBS) process in accordance with City Code 5.34 to obtain the most qualified firm or firms. The Chief Procurement Officer is authorized to award, negotiate and execute contracts, provided the contract has been approved as to form by the City Attorney’s Office. Section 2. The Council declares that an emergency exists because current contracts are expiring and capital projects are in need of environmental services ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
