Impact statement

Purpose & background

The ordinance enables PBOT and the City of Portland to continue delivering federal aid capital projects through the Local Agency Certification Program administered by the Oregon Department of Transportation (ODOT). New or revised federal and state requirements for federal-aid project delivery necessitate a new, updated Local Agency Certification Program Agreement between the City and ODOT, attached as Exhibit A.

Financial impacts

This program agreement alone does not commit City financial resources. It enables the City to enter into Supplemental Project Agreements for specific capital projects that do commit City financial resources to match federal grants. These future Supplemental Project Agreements will be adopted by Council separately on an individual basis. The program agreement does require the City to follow federal regulations pertaining to federal-aid project delivery, which include additional processes and documentation compared to locally-funded projects. There is no substantial change in these federal requirements compared to the existing program agreement.

Community impacts

This program agreement alone does not initiate projects or other actions by the City that would cause community impacts or necessitate community involvement. Supplemental Project Agreements for individual capital projects will require the City to perform public involvement for projects in the future.

The City of Portland ordains: Section 1. The Council finds: The City of Portland entered into an agreement authorized by Ordinance 179568 with the Oregon Department of Transportation (ODOT) on February 10, 2006 to participate in the ODOT Local Agency Certification Program for federal-aid project delivery on a trial basis (Agreement No. 52582). On July 11, 2012 by Ordinance No. 185481, the City and ODOT entered into updated Agreement No. 33000090 acknowledging that the City is fully certified in design engineering; advertising, bid and award; and contract administration for federal-aid projects. On September 18, 2015 by Ordinance No. 187311, the City and ODOT entered into updated Agreement No. 33000146 reflecting modified federal and state provisions. Additional and revised federal and state provisions require the City and ODOT to enter into a new, updated Local Agency Certification Program Agreement. Any existing Supplemental Project Agreements entered into under Agreement No. 33000146 shall remain in full force and effect under the authority of Agreement No. 30890, and be governed by its terms, until such time as the Supplemental Project Agreement expires or is terminated according to its terms. NOW, THEREFORE, the Council directs: The Commissioner-in-Charge is hereby authorized to sign Local Agency Certification Agreement with the Oregon Department of Transportation substantially similar to attached as Exhibit A, superseding and replacing Agreement No. 33000146. Section 2. The Council declares that an emergency exists because this Agreement allows the City to continue delivering infrastructure and safety improvements without delay ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
