*Amend Intergovernmental Agreement with Metro to add three years and additional $200,000 for light detection and ranging data and aerial imagery (amend Contract 30003993)

The City of Portland ordains: Section 1. The Council finds: The City participates in The Regional Aerial Photo Consortium (Consortium), managed by the Metro Data Resource Center, which enables the joint purchase of Aerial Imagery, LiDAR data and allied products by Consortium members. The intent of the Consortium is to provide a cost-effective means to acquire these types of products. Metro purchases, on behalf of the Consortium, Aerial Imagery, LiDAR data and allied products in support of many varied planning, transportation, construction, facility management, land management and related programs and projects. The costs are then prorated among the participating Consortium members. On July 23, 2014, the Council passed Ordinance No. 186722 authorizing execution of an intergovernmental agreement (IGA) with Metro for the City to obtain LiDAR data. On July 1, 2014, IGA No. 30003993 with Metro for the purchase of LiDAR Data became effective. On May 13, 2020, the Council passed Ordinance No. 189957 authorizing the extension of IGA No. 30003993 with Metro for the purchase of LiDAR Data through September 30, 2024. The City wishes to obtain a new set of LiDAR data and aerial imagery from Metro through execution of an amendment which will permit Metro to provide the data and products and to invoice the City for its prorated share of the data and products. The amendment will enable the City to obtain a current, uniform high-resolution set of LiDAR data set for the region and will complete the annual update of aerial imagery. This data is used for the identification of landslides, earthquake faults, and storm water modelling, long-range planning, impervious areas as well as updating a number or other key datasets needed for planning and asset management. NOW, THEREFORE, the Council directs: The City's Chief Technology Officer is hereby authorized to execute an amendment to intergovernmental agreement 30003993 to acquire LiDAR data and aerial imagery from Metro for an additional three (3) years, and add $200,000.00 in ongoing payments, for a new not to exceed total of $760,000.00, and a new expiration date of September 30, 2027, provided it has been approved as to form by the City Attorney’s Office. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the Intergovernmental Agreement; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
