The City of Portland ordains: Section 1. The Council finds: The City and the Portland Fire Fighters’ Association (PFFA) are parties to a Collective Bargaining Agreement (CBA) for the period of July 1, 2023 through June 30, 2027. The PFFA filed an unfair labor practice complaint alleging a violation of the Public Employees Collective Bargaining Act (PECBA), ORS 243.672(1)(g), ORS 243.672(1)(a), and ORS 243.672(1)(c). The City denied the allegations in the complaint. The PFFA and the City are interested in resolving the ULP without further litigation and have come to an agreement that is conditioned on approval by City Council. The agreement, attached as Exhibit A, provides for reinstatement of 72 hours of sick leave and payment to the PFFA for attorney fees in the amount of $5,000.00 The agreement will foster labor harmony by resolving a dispute. NOW, THEREFORE, the Council directs: The Letter of Agreement attached as Exhibit A is approved and the City shall comply with the terms stated therein. This ordinance is binding City policy. Section 2. The Council declares that an emergency exists for the authorization of the Letter of Agreement because it promotes labor harmony; therefore, this Ordinance shall be in full force and effect after its passage by the Council.
