*Authorize Letter of Agreement to approve inclement weather compensation for certain Laborers’ International Union of North America Local 483 recreation casual employees

The City of Portland ordains: Section 1. The Council finds: The City and LiUNA, Local 483 (LIUNA) are parties to a collective bargaining agreement (CBA) effective July 1, 2022 through September 30, 2026. LiUNA is the exclusive bargaining representative of employees working in the Recreation Associate classification covered under Schedule C of this CBA. Schedule C of this CBA reflects the parties' agreement regarding work schedules for these employees. On January 12, 2024, Portland Mayor, Ted Wheeler, issued an Emergency Declaration Due to Severe Cold Weather, ED-2024-01. Severe weather caused the City to close a number of recreation facilities throughout the period of January 12, 2024 to January 19, 2024, which resulted in a loss of income for previously scheduled Recreation Associates who work at the recreation facilities that were closed. LiUNA Local 483 filed a demand to bargain with the City on January 24, 2024. The parties mutually agreed to resolve this issue outside of the bargaining process. The Letter of Agreement shall be signed by the City and LiUNA local 483 and shall conform substantially to a form similar to the Agreement attached as Exhibit A. NOW, THEREFORE, the Council directs: The Chief Human Resources Officer is authorized to enter into a Letter of Agreement between the City and LiUNA Laborers' Local 483 for inclement weather compensation for LiUNA Local 483 Recreation Casual Employees During January 2024 Severe Weather Event in a form substantially similar to attached Exhibit A. Section 2. The Council declares that an emergency exists because delay would prevent impacted employees from receiving timely compensation; therefore, this Ordinance shall be in force and effect from after its passage by the Council.
