The grant agreement with Oregon Department of Transportation, as stipulated in the Approved Project Description within Exhibit A of the grant agreement (Exhibit A), is for an approximately 165’ path from NE 106 th Avenue to San Rafael Street, lighting improvements, and a new mid-block ramp sidewalk connection. The estimated project cost of $552,955 is based on a preliminary engineering estimate from August 2022 considering a five-year inflation rate and 30% contingency. Costs for this project will be posted to PBOT Capital Project T01385, which is included in PBOT’s Requested FY 2024-25 Budget and five-year CIP forecast. More details about the contract or project to explain the purpose of taking this document to Council, if necessary. Maximum reimbursement on the grant is 70%, resulting in a 30% minimum local match. Local match in the amount of $165,887 will be provided by funds from a General Fund allocation to the Safe Routes to School program for ongoing infrastructure work in East Portland. The funds for improving Safe Routes to School were approved by Council as part of the Fall BMP process in November of 2021. No additional funding or staffing is requested with this Ordinance.

Community impacts

PBOT received a letter of support for this grant from the Parkrose School District. The NE 106 th Avenue pathway was included in the 2012 City Council-adopted East Portland in Motion (EPIM) plan, a strategy for active transportation projects east of 82 nd Avenue. This project was identified in partnership with East Portland neighborhoods and organizations, overall, a total of $80 million in projects.

The City of Portland ordains: Section 1. The Council finds: Portland Bureau of Transportation applied to Oregon Department of Transportation for a grant in the amount of $387,068 for a paved pathway and crossing improvements on 1/31/2023; and Oregon Department of Transportation has notified the City of Portland that it will award a grant for the pathway paving and route improvements between NE 106th Avenue and NE San Rafael Street and crossing improvements at NE San Rafael to Portland Bureau of Transportation in the amount of $387,068; The project number for this is T01385. The grant number is TR000373. The NE 106 th Avenue pathway project is an unfunded link in the 100s Neighborhood Greenway. It is a designated Neighborhood Walking Route, a Safe Routes to School Primary Investment Route and connects to transit stops. The NE 106 th Avenue pathway will improve connectivity on a low-traffic route, supporting themes heard in East Portland in Motion (EPIM) planning interviews: better transit access, more off-street paths for biking, and to focus on children. The Oregon Community Paths Program is dedicated to helping communities create and maintain connections through multi-use paths to improve access and safety for people walking and bicycling. NOW, THEREFORE, the Council directs: The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for the pathway paving and route improvements between NE 106th Avenue and NE San Rafael Street and crossing improvements at NE San Rafael in the amount of $387,068. The Commissioner-in-Charge to execute an Intergovernmental Agreement in the amount of $387,068 in a form similar to the contract attached as Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty-five percent (25%) or greater. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
