Purpose & background

This legislation authorizes the PHB Director to amend contracts with other public agencies, or nonprofits or for-profits representing those jurisdictions, to provide licensing and software support for the federally required Homeless Management Information System (HMIS) ServicePoint software. PHB is in the process of transferring this responsibility to Multnomah County, per Ordinance 191449, as Multnomah County is the primary responsible local jurisdiction for the provision of homeless programs and services. Multnomah County is conducting a software implementation which will not be finalized until early 2024. Current IGAs with Clackamas County and Washington County to provide licenses and support are in need of amendment to keep the services going in the interim. The authorizing ordinances for this program, 182211 and 185152, did not include authority to amend agreements. The proposed legislation supports an existing City program and does not change any City policies.

Financial impacts

This legislation will enable PHB to continue to receive revenue for the next few months to provide licensing and support to Washington and Clackamas County. A revenue increase to existing IGAs of approximately $75,000 is projected. This does not require appropriation as PHB already has budgeted the revenue in the Adopted budget. This legislation does not impact PHB’s budget in the long term, as this program will transfer to Multnomah County by the end of the FY23-24.

The City of Portland ordains: Section 1. The Council finds: Ordinance 182211, passed on September 24, 2008, authorized the Director and Auditor to execute IGAs for the purpose of local public agencies’ utilization and cost sharing for the PHB-implemented, federally-required homeless management information system Ordinance 185152, passed on February 15, 2012, authorized Portland Housing Bureau (PHB) Director and the City Auditor to execute these revenue generating agreements with not-for-profit and for profit agencies. Ordinance 191449, passed on September 13, 2023, authorized the transfer of the responsibility for the provision of this service to Multnomah County. Multnomah County has not yet implemented its software solution for this program, delaying the transfer. Current revenue-generating agreements between the Housing Bureau and participating jurisdictions must be amended to allow for continuation of this federally-required service. NOW, THEREFORE, the Council directs: The PHB Bureau Director is hereby authorized to amend intergovernmental and revenue generating agreements with public agencies, and not-for-profit and for profit agencies, for the purpose of providing federally-required homelessness management information software services. The Mayor and Auditor are hereby authorized to receive payment from participating agencies. Section 2. The Council declares that an emergency exists because delay in approval would interrupt City of Portland's ability to provide licensing and receive revenue; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
