*Authorize contract with Axon Enterprises, Inc. to purchase body-worn camera equipment and accessories not to exceed $10 million for an initial term of five years

The City of Portland ordains: Section 1. The Council finds: The Police Bureau (PPB) has conducted research into body-worn camera technology and recently completed a competitive solicitation to allow for the initiation of a body-worn camera program with the most effective and appropriate equipment. On February 9, 2022, Council approved Ordinance Number 190696 for Procurement Services to use a Contract-Specific Special Procurement procedure in accordance with Portland City Code 5.33 to enter into contract to pilot-test body-worn cameras from proposers within the solicitation’s Competitive Range. On April 1, 2023, the PPB entered into a contract to pilot body-worn cameras from the highest scoring proposer, Axon Enterprises, Inc. (Axon). The evaluation committee tested the Axon body-worn camera system starting August 21, 2023, and ending on October 19, 2023. Every member of the evaluation committee approved the body-worn camera system with a passing score. Having completed a pilot program to test the viability of equipment, policies and procedures, and implementation opportunities if they scaled to a larger deployment, PPB has decided to move forward with a contract with Axon to implement the system at larger scales. The current authorization for this procurement, Ordinance 190696, allowed one-time funding for a contract to be issued up to a limit not-to-exceed $2,600,000. The Council-authorized contract would allow the City to initiate the body-worn camera program; but the contract would have to be amended to increase the not-to-exceed limit within the first two years. Given the information learned during the pilot program, the Police Bureau would like to secure a contract with a not-to-exceed limit that would allow the Bureau to fully implement and sustain a comprehensive and robust body-worn camera program for at least five years. PPB estimates that the City will need approximately $2,000,000 per year to implement this program effectively and successfully. This cost includes an amount being used to act as a buffer for future expenses as a risk mitigation strategy. Axon’s 2022 proposal offered a price with discounts totaling $3,700,000. Axon is willing to honor those contract discounts in 2024, however, the discounts will be applied to the 2024 manufacturer’s suggested retail price (MSRP). The 2024 MSRP price increase is approximately $1,500,000 over the term of the five-year contract. Immediate action is required to ensure a contract with Axon avoids the price increase starting in 2024, saving the City approximately $1,500,000 over the five-year contract. NOW, THEREFORE, the Council directs: The Chief Procurement Officer is authorized to award and execute a contract with Axon Enterprises, Inc, in an amount not-to-exceed $10,000,000 for a term of five years, provided that the contract conforms to processes outlined in PCC 5.33 and is approved as to form by the City Attorney's Office. Section 2. The Council declares that an emergency exists because the delay to enter into a contract will forfeit approximately $1,500,000 dollars due to price increases in 2024; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
