*Authorize Intergovernmental Agreement with TriMet for recurring traffic signals work and related improvements

The City of Portland ordains: Section 1. The Council finds: The City recognizes TriMet’s recurring traffic signal work and related improvements that include rail reliability, rail crossing safety enhancements, track rehabilitation, traffic signal modifications or improvements, and other similar transit system upgrades. PBOT will provide design review services for TriMet, and TriMet shall reimburse PBOT for the reasonable cost such design reviews and approvals. TriMet will reimburse PBOT for all reasonable and necessary consulting, managerial, administrative, review and technical costs incurred by PBOT on any Project subject to this IGA, including all required shop time, labor, hardware and software associated with work performed by PBOT. TriMet will provide to the City of Portland with a budget not to exceed amount of $950,000 for all work within this IGA. The City also has an interest in creating a transportation system that is safe, comfortable, and accessible to people of all ages and abilities; and Through the Vision Zero program, the City and our partners are working to eliminate deaths and serious injuries on our streets; and The City has an interest in creating conditions that make bicycling attractive and prioritizing transit trips. NOW, THEREFORE, the Council directs: The Commissioner-in-Charge from the Portland Bureau of Transportation is hereby authorized to execute an Intergovernmental Agreement with TriMet in a form similar to the attached Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk. Increases to the contributory amount must be approved by the City Council. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the Intergovernmental Agreement ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
