Purpose & background

Portland Fire & Rescue (PF&R) participates in a regional hazardous materials emergency response team within the boundaries of the Emergency Response Area, when requested by the State Fire Marshal (OFM). It is necessary for the City and OFM to enter this agreement so that PF&R can respond to hazardous materials emergencies within the boundaries and receive reimbursements.

The related expenditures and revenues are included in PF&R’s current budget. The expenditures and revenues are approximately $40,000 annually and are included in PF&R’s HazMat budget.

The City of Portland ordains: Section 1. The Council finds: Portland Fire & Rescue (PF&R) participates in a regional hazardous materials emergency response team when requested by the Department of State Fire Marshal (OSFM), within the boundaries of the Emergency Response Area. The Fire Chief recommends that the City execute this Agreement, and states that participation on the Regional Hazardous Materials Team will not impair the ability of PF&R to protect the citizens of Portland. NOW, THEREFORE, the Council directs: The Portland Fire & Rescue Chief is authorized to execute this Intergovernmental Agreement for Regional Hazardous Materials Emergency Response Team Services for participation by Portland Fire & Rescue, in a form substantially similar to the agreement attached as Exhibit 1. The Portland Fire & Rescue Chief is authorized to amend this Intergovernmental Agreement on behalf of the City provided that the amendment does not increase the City’s financial obligation under the agreement and the amendment is approved as to legal sufficiency.
