*Amend FY 2023-24 budget and appropriate $6,621,827 from Intergovernmental Agreement with Multnomah County for emergency shelter expansion and update signature authority (amend Ordinance 191400)

The City of Portland ordains: Section 1. The Council finds: On August 2, 2023, Council passed Ordinance 191400 to authorize the execution of an intergovernmental agreement (IGA) with Multnomah County to accept pass through grant funding from the Oregon All In Initiative in the amount of $6,621,827 to support the City’s emergency shelter expansion. That prior Ordinance incorrectly delegated authority to the Commissioner in Charge of PHB to execute the IGA. With the emergency shelter expansion project as part of the Mayor’s portfolio and with the mayoral team working diligently to collaborate with the Governor’s Office as well as Multnomah County, the Mayor should be delegated authority to execute the IGA. The grant funding from the IGA shall amend the City’s FY 2023-2024 budget, with the funds added to the Grant Fund, Fund 217. NOW, THEREFORE, the Council directs: The Mayor, or designee, is authorized to execute an Intergovernmental Agreement in the amount of $6,621,827, in the form substantially similar to the Exhibit A approved through Ordinance 191400, upon approval as to form by the City Attorney. The FY 2023-24 budget is hereby amended as follows: GRANTS FUND Fund 217 Business Area MF00 Bureau Program Expenses $6,621,827 The Mayor, or designee, is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of the Intergovernmental Agreement, provided the changes do not increase the City of Portland’s legal risks or financial obligation. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Mayor’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
