Impact statement

Purpose & background

The PIR Pump Station was constructed during the 1950s and it has reached the end of its expected service life. The pump station provide drainage necessary to maintain access to and operations of Portland International Raceway (PIR), Heron Lakes Golf Course, City roads and Right-of-Way. City Staff obtained state and federal grant funding to provide 100% of the cost to design a replacement of this asset. This action will reduce the risk of flooding and ensure long-term access to and operation of City assets. The action provides pass-through funding to PEN1, which will assume legal ownership of the asset following the completion of this project. This outcome will reduce uncertain City financial liability in the future. This action follows previous City Council action to apply for and accept grant funding for this project. This action is also supported in the City’s adopted Natural Hazard Mitigation Plan.

Financial impacts

This action reduces long-term City financial impacts. The City will no longer have direct financial liability for the PIR Pump Station. This project will transfer this asset to PEN1 and ultimately to the new Urban Flood Safety and Water Quality District (UFSWQD). The City will no longer directly contribute to the ongoing maintenance of the PIR Pump Station. All funds for this IGA are provided by the state and federal government. This action does not alter the City budget. This action does not authorize additional or new spending. City staff have a high level of confidence that the grant funding is sufficient to complete the project. This action does not impact future revenues, fund sources or staffing. This action will require approximately 8.0 per month to prepare grant reports. This action creates an IGA to provide grant funds obtained by the state and federal government, from the City to PEN1.

The City of Portland ordains: Section 1. The Council finds: The Portland International Raceway (PIR) Pump Station provides essential drainage and flood mitigation in Peninsula Drainage District #1 (PEN1), the area of the historic Vanport Flood of 1948. 77% of PEN1, an Oregon Special District, is comprised of City-owned real property, including those City assets and properties at the lowest elevation in the managed floodplain. The PIR Pump Station was constructed in the 1950s and is at the end of its service life. Replacement of the PIR Pump Station is called for in the City’s Natural Hazard Mitigation Plan. Federal Emergency Management Agency (FEMA) and Oregon Office of Emergency Management (OEM) distribute grant funds to public agencies that have adopted Natural Hazard Mitigation Plans. The City applied for FEMA and OEM funds that will pay 100% of the PIR Pump Station replacement design costs. The Council approved the application and acceptance of these grant funds. PEN1 has a program to rehabilitate and replace pump stations in the managed floodplain of the Columbia Corridor drainage districts. An intergovernmental agreement is needed under which the City will supervise the invoice-based payment of state and federal grant funds to PEN 1 to complete the project. NOW, THEREFORE, the Council directs: The Chief Administrative Officer to execute an intergovernmental agreement with Peninsula Drainage District #1in substantial conformance with Exhibit A. Section 2. The Council declares that an emergency exists because the grant award period has started and is limited to three years, additionally, the PIR Pump Station has reached the end of its service life; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
