Accept grant from ODOT to deliver above mentioned safety project on SE Division. Scope includes the conversion of two segments of existing two-way left turn median on SE Division between SE 148 Avenue and SE 174 th Avenue (specifically the segments of SE 152 nd to 160 th and 166 th to 174 th ).

Total project cost is approximately $2,595,878 (low to medium confidence level). The internal capital project number is T01102 and the grant number is TR000363. The project is currently budgeted in PBOT’s Adopted FY 2023-24 Budget and included in the five-year forecast. The project includes $2,393,927 in federal grant funds administered through ODOT. PBOT is providing the required local match of $201,960 through GTR.

Community impacts

As part of the design phase for this project, PBOT staff will conduct additional, targeted public outreach within the anticipated project segments (SE Division between SE 152 nd and 160 th and 166 th to 174 th ) to ensure that access is supported for emergency response as well as for businesses, properties, and residents within the project area. Previous engagement regarding access management for the entire SE Division Street corridor also occurred as part of the robust outreach through PBOT’s Outer Division Safety Project and TriMet’s Division Transit Project between 2018 and 2020.

The City of Portland ordains: Section 1. The Council finds: The Portland Bureau of Transportation applied to the Oregon Department of Transportation for a grant in the amount of $2,393,927 for conversion of portions of the existing two-way left turn lane to a raised center median on SE Division between SE 148th and 174th on 6/6/2018; and The Oregon Department of Transportation has notified the City of Portland that it will award a grant for the SE Division Street: 148th Avenue to 174th Avenue Project to the Portland Bureau of Transportation in the amount of $2,393,927; The project number for this is T01102. The grant number is TR000363. The project is currently budgeted in FY 23-24 and included in the five-year forecast. NOW, THEREFORE, the Council directs: The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for the (SE Division Street: 148th Avenue to 174th Avenue Project in the amount of $2,393,927. The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $2,393,927 in a form similar to the contract attached as Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty percent (20%) or greater. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
