*Pay Workers’ Compensation Claims of Michael Thompson for $25,039 involving Portland Parks & Recreation

The City of Portland ordains: Section 1. The Council finds: Michael Thompson, through his attorneys, Welch, Bruun & Green, has filed workers’ compensation claims against the City for damages suffered on February 17, 2021, and February 22, 2021. The claims have been investigated by Risk Management Services. The investigation indicates there is risk the city may be found liable. Therefore, in order to avoid the risk of an adverse decision, we feel it is prudent to compromise the claims at this time. Risk Management Services recommends the claims be compromised for the total sum of $25,039.09 with the amount of $10,000.00 still due, subject to the claimant providing the city with a release in a form to be approved by the City Attorney. NOW, THEREFORE, the Council directs: The Mayor and City Auditor are hereby authorized to draw and deliver a check in the amount of $10,000.00 made payable to Thompson’s attorneys: Welch Bruun & Green. Risk Management Services will execute a payment authorization in the amount set forth in sub-paragraph (A) above. Portland Parks shall waive collection of overpaid wages in the amount of $15,039.09 as part of the consideration for the settlement of the workers’ compensation claims. Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling these workers’ compensation claims; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
