Purpose & background

The City of Portland has been party to the Oregon Public Works Emergency Response Cooperative Assistance Agreement since 30 January 1991 with renewals occurring approximately every five years. This agreement allows for the request of resources by any jurisdiction signed on to the agreement and provision of those resources by another and provides a procedure for requesting resources, responding to requests for resources, and interagency reimbursements.

Financial impacts

As this is a voluntary agreement, there is no immediate budget impact. If the City of Portland requests and uses resources, the City of Portland will pay the providing jurisdiction for resources received. The funding for this expense will come from the budget in the fiscal year in which the services are rendered. If the City of Portland provides resources, the City of Portland agrees to be reimbursed by the requesting jurisdiction for resources provided.

The City of Portland ordains: Section 1. The Council finds: On November 4, 2020, Council approved the Oregon Public Works Emergency Response Cooperative Assistance Agreement by Ordinance No. 190187; and That State Law (ORS Chapter 401.480, and ORS Chapter 190) provides for collaboration among public and private agencies; and That such collaboration is common in the law enforcement and in fire service; and That such collaboration in between public works agencies is also of significant value in response and recovery operations in an emergency; and That such collaboration between public works has been in place among the governments of the State of Oregon for over twenty-two years and thus needs to be renewed; and That such collaboration is in the tradition and public interest of the Portland Metropolitan area and should be developed and expanded. NOW, THEREFORE, the Council directs: The Mayor and Auditor are authorized to execute the Oregon Public Works Emergency Response Cooperative Assistance Agreement between the City of Portland, the Oregon Department of Transportation and others attached as Exhibit A; and That this agreement supersedes Ordinance 190187 dated November 4, 2020; Agreement 30004048, Ordinance No. 186530 dated April 11, 2014; 181991, dated July 2, 2008; Ordinance No. 176697, dated July 10, 2002; Agreement No. 50999, dated February 4, 1998 (Ordinance No. 171867); Agreement No. 28302, dated October 14, 1992 (Ordinance No. 165883); and No. 26840, dated January 30, 1991 (Ordinance No. 163828); and That the Oregon Public Works Emergency Response Cooperative Assistance Agreement be a non-exclusive agreement and that other agencies be encouraged to become parties to it; and That the Portland Bureau of Emergency Management is authorized to execute the documentation for this agreement due to the multiple disciplines currently and potentially involved.
