Authorize the Director of the Bureau of Environmental Services to enter into an Intergovernmental Agreement with the Port of Portland for reimbursement of costs incurred for the design and construction of replacement for the Alderwood Pump Station and Force Main, BES Project E11393 (Ordinance).

Financial impacts

The IGA provides for reimbursement of costs incurred by BES without further amendments. Reimbursement covers estimated costs for design and construction of a replacement for the Alderwood pump station. Payments are anticipated to occur over a period of 4 years.

Community impacts

This pump station serves people working in middle wage and federal jobs at the Port of Portland. The service area is primarily businesses, with very few residences. The Port recognizes the need for addressing deficiencies and operational challenges of this pump station by replacing it. The Port also is willing to enter into a permanent easement with BES for the future location of the pump station and to turn over ownership of the new pump station to BES. Upon completion of the new pump station, the existing pump station will be decommissioned, and the Port may develop the property as desired.

The City of Portland ordains: Section 1. The Council finds: The Port of Portland (Port) is the Owner of the Alderwood Pump Station and has a separate Intergovernmental Agreement (IGA) with the Bureau of Environmental Services (BES) to provide ongoing repair, maintenance, and operations. BES and the Port recognize that the existing pump station does not meet current BES design standards, has exceeded its design useful life, and that replacement of the pump station is needed. Deficiencies at the pump station, combined with the age of the pump station and continuous operational challenges, necessitate the planning, design, and construction of a replacement station. Following completion of the construction of the replacement Alderwood Pump Station and Force Main, Ownership of the replacement Alderwood Pump Station will be transferred to BES. BES will continue to repair, maintain, and operate the pump station. BES and the Port desire to enter into an Intergovernmental Agreement (IGA) to set forth the responsibilities, costs, and schedules of action of each party with respect to the planning, design, and construction of the Alderwood Pump Station and Force Main Replacement Project. The IGA will provide reimbursement of all project costs from the Port to BES. BES will bill the Port on a quarterly basis as services are provided. Payments will be deposited to the Sewer System Operating Fund and credited to the appropriate BES cost object. NOW, THEREFORE, the Council directs: The Director of Environmental Services is authorized to execute Intergovernmental Agreements in a form similar to the agreement attached as Exhibit A and for the purpose described in Section 1. The Director of the Bureau of Environmental Services is authorized to execute amendments to this agreement provided that such amendment does not obligate BES to make payments to the other agency.
