This ordinance will allow Parks to close on the purchase of three tax lots, totaling .57 acres, adjacent to Loll Wildwood Natural Area. This donation will buffer the natural area from development and add park land, which will increase the capacity of the park system.

Financial impacts

The property is being donated free of charge but there will be due diligence, closing, and stabilization costs. All acquisition and stabilization costs will be paid with Parks’ SDC funds. The SDC Funding Request has already been approved. O&M is estimated at approximately $600 annually and will be requested through the budget process.

Community impacts

The community was not directly involved in this acquisition, but this acquisition will increase the capacity of the park system by adding natural area to Forest Park. No opposition to this ordinance is expected.

The City of Portland ordains: Section 1. The Council finds: In accordance with the terms and conditions of a Donation Agreement dated November 3, 2022 and authorized by Ordinance 180626, Portland Parks & Recreation (Parks) wishes to accept the donation of .57 acres of real property located on SW Arnold Street, described as WEST PORTLAND PARK, Block 34, Lots 27-36 (Property). The Property will buffer Loll Wildwood Natural Area from development and will be managed as part of the natural area, increasing its capacity. As the property is being donated, there is no purchase price, but there are due diligence, closing, and other costs that will be paid with Parks System Development Charge acquisition funds. Operation and Maintenance funding is estimated at approximately $600 annually and will be requested through the budget process. NOW, THEREFORE, the Council directs: The Director of Parks to execute any amendments to the Donation Agreement and all closing documents and to take all other actions necessary to close the transaction in accordance with the Agreement and any amendments thereto. All documents must be approved as to form by the City Attorney prior to execution. The Director of Parks to pay the closing costs to First American Title Company. Such payments shall be made using Parks SDC funds. The Director of Parks to add the Property to the City’s Park inventory. Section 2. The Council declares that an emergency exists because donation of property is contingent on closing by the end of 2022; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
