*Authorize competitive solicitation for the construction of the 82nd Ave Crossings: Klickitat-Lambert, NE/SE Project

The City of Portland ordains: Section 1. The Council finds: The City of Portland has the responsibility of providing safe transportation routes for commerce, convenience and to adequately serve the traveling public. 82nd Avenue serves as an important street in the city of Portland for people walking, biking, taking transit and driving. It provides access to businesses, homes and institutions. Through HB 5006, the State of Oregon committed to $150M in funding for state of good repair and safety improvements to 82nd Avenue. The City of Portland has committed $35M in funding for improvements to the corridor. The state’s initial contribution of $80,000,000 is American Rescue Plan Act (ARPA) funding and will be used to fund critical safety and maintenance projects, as well as planning for future phases. This funding must be obligated by December 31, 2024 and expended by December 31, 2026. On April 28, 2022, the Council approved Ordinance 190795 approving an Intergovernmental Agreement with the Oregon Department of transportation for the Jurisdictional Transfer of Portions of 82nd Avenue, acceptance of $80,000,000 in ARPA funding for improvements to 82nd Avenue with the Oregon Department of Transportation, and to appropriate $615,000 in the FY 21-22 budget. The project known as 82nd Avenue Crossings: Klickitat-Lambert, NE/SE Project (the “Project”) has been planned in accordance with appropriate engineering standards for the construction, maintenance or improvement of said transportation infrastructure such that property damage is minimized, transportation promoted, and travel safeguarded. The Project will be constructing new signalized pedestrian crossings on 82nd Avenue at NE Klickitat, NE Schuyler, SE Clinton and SE Schiller. These pedestrian crossings will include median islands with trees. The ADA ramps at the crossings will be reconstructed to meet current ADA standards. The Bureau of Transportation has funds budgeted in FY 2023 and proposed FY 2024 for construction, inspection and management of the project. The Bureau's level of confidence in the cost estimate for this project is high; the project is defined and plans and specifications are nearing completion. NOW, THEREFORE, the Council directs: The Chief Procurement Officer is authorized to facilitate the competitive solicitation process in accordance with City Code 5.34 to obtain the lowest most responsible bidder. Upon the Council’s acceptance of the Chief Procurement Officer’s report recommending the lowest responsible bidder, the Chief Procurement Officer is authorized to award, negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney’s Office. The improvements may be constructed in whole or in part by the City of Portland, or the City of Portland may seek bids for any portion of the 82nd Avenue Crossings: Klickitat-Lambert, NE/SE Project. The manner in which the improvements are constructed is at the sole discretion of the City Engineer. The Mayor and City Auditor are hereby authorized to draw and deliver warrants chargeable to T01179 when demand is presented and approved by the proper authority. Section 2. The Council declares that an emergency exists because delay would unnecessarily delay the City’s ability to perform the activities authorized by the ARPA funding ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
