This legislation is an administrative clean-up of City code to ensure it conforms with state law. Portland Parks & Recreation (PP&R) manages several municipal boat docks throughout the city, and, from time to time, vessels are left abandoned or derelict on City docks. PP&R works with boat owners to move these vessels, but occasionally finds that no owner can be located to take responsibility for a vessel that has been left. In these cases, PP&R must physically seize the vessel to remove it from a dock. Oregon Revised Statues prescribes the appeal process for persons who may have an interest in a vessel that has been marked for removal by PP&R. This Ordinance ensures City Code conforms to those appeal rights and provides a mechanism for persons to appeal to the Code Hearings Office if a vessel has been marked by PP&R for removal from a municipal dock.

The City of Portland ordains: Section 1. The Council finds: City Code Subsection 19.16.060 J. relates to the removal of derelict and abandoned vessels on docks managed by the City of Portland, including those under the control of Portland Parks & Recreation. The City Attorney, Portland Parks & Recreation, and the Code Hearing’s Office recommends changes to the Code to clarify rights and responsibilities for both the City and boat owners when a vessel is proposed for seizure or has been seized. The recommended changes will ensure the Code conforms to the standards of vessel seizures prescribed by the Oregon State Marine Board and Oregon Revised Statutes. NOW, THEREFORE, the Council directs: Amend City Code Subsection 19.16.060 J. as shown in Exhibit A.
