Purpose & background

The Bureau of Environmental Services (BES) needs to execute an Emergency Procurement Contract for Sewer Repair at NE 33 rd Ave and NE Knott St. BES discovered a severely deteriorated 110-year-old 66-inch sewer junction chamber structure with no access from the street surface. The 20-foot-deep combined sewer junction chamber has multiple holes and has no bottom of pipe in some locations. Additionally, there are two sinkholes approximately 60 feet south of the junction chamber structure. These sinkholes will be repaired through the course of the construction activities. The sinkholes in the area and the deteriorated junction chamber structure present a high risk to the public and will be repaired. Given the poor condition of this asset, it is more cost effective to replace it rather than to attempt a repair. Replacing the structure also provides the long-term benefit of improved access to the system in this location for future maintenance and will facilitate repairs needed to other assets in the direct vicinity. The junction chamber has reached the end of its service life and needs to be replaced.

Financial impacts

Engineer’s estimate including contingency for the full replacement is $960,000. The lowest responsive bid received for this solicitation was from Moore Excavation Inc. and was $724,100.00 Funds being allocated for this work is $960,000, which allows for $235,900 for contingency. Because the low bid for the project came in under the engineer’s estimate, the level of confidence for this estimate is high.

Community impacts

NE 33 rd Ave between NE Knott St and NE Broadway St will be closed to local traffic only during the replacement work. The construction zone needed for the replacement will not allow for maintaining traffic on NE 33 rd through the area. Through traffic will be detoured to NE 15 th Ave. Although local traffic will be allowed from NE Broadway St north, no traffic will be allowed through to NE Knott St. Although there will be significant traffic impacts, this work will reduce the risk and improve system reliability for years to come. BES Public Involvement (PI) is assisting with community outreach on this project. PI has developed a contractor door notice that includes construction impacts and contact information for the PI hotline and MEI, the contractor. Since this is an emergency, PI will be utilizing the Public Involvement Hotline to receive incoming inquiries or comments about the project. A PI representative monitors the hotline, so inquiries are still received when staff are on leave. The PI representative will respond as needed and will work with the construction team to solve any issues that may arise in the field. PI will be sending out a traffic advisory as well a Nextdoor post discussing the project and its impacts during construction. PI will be working with Portland Public Schools to discuss the project and help coordinate bus/pedestrian traffic around the project area.

The City of Portland ordains: Section 1. The Council finds: The Bureau of Environmental Services (BES) needs to execute an Emergency Procurement Contract with Moore Excavation, Inc. for sewer repair at NE 33 rd Ave and NE Knott St. In late May 2022, as a result of a sinkhole appearing at NE 33 rd Ave and NE Knott St, BES discovered a severely deteriorated 110-year-old 66-inch sewer junction chamber structure with no access from the street surface. The 20-foot-deep combined sewer junction chamber has multiple holes and has no bottom of pipe in some locations. Alternative’s analysis was prepared by a design consultant resulting in recommending the full replacement of the junction chamber structure with a new 144-inch maintenance hole. NE 33 rd Ave and NE Knott St are both high volume roads. NE 33 rd Ave is also being repaved this summer by PBOT. NE 33 rd Ave contains a 24” cast iron water main and 8” cast iron water main. NE Knott St contains a 8” cast iron water main. NE 33 rd Ave contains a 6” steel gas main. In order to minimize the impact of traffic and the neighborhood, and to protect and maintain other utilities above the junction chamber structure, NE 33 rd Ave from NE Knott St to NE Broadway St will be closed so the work can be completed. Construction in anticipated to be completed ahead of the summer PBOT paving project. Engineer’s estimate for the full replacement recommendation is $960,000, construction duration is anticipated to be six (6) weeks. Any work performed in this intersection, any alternative rehab or replacement approach, will have an impact on traffic and the level of effort required will be significant. Replacing the 110-year-old junction chamber structure with a new maintenance hole resolved the immediate need and provides a long-term permanent solution with future access for inspection and maintenance and trenchless repair methods, if needed. The established cost is $960,000. Funds are available in the Sewer System Operating Fund, FY23 Budget, Bureau of Environmental Services, BES Project No E11501. Procurement conducted a competitive solicitation process for the lowest responsive bidder in accordance with chapter 5.34 of the Portland City Code. Lowest responsive bid was Moore Excavation, Inc. in the amount of $724,100.00. Therefore allocating $235,900 for contingency for the construction contract. NOW, THEREFORE, the Council directs: The Chief Procurement Officer is authorized to negotiate and execute on behalf of the City an emergency procurement contract with Moore Excavation, Inc. for the purposes described in Section 1, provided the contract has been approved as to form by the City Attorney's Office. The Mayor and Auditor are hereby authorized to pay for the contract from the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority. Section 2. The Council declares that an emergency exists because of the risks associated with the traveling public, property, and the existing utilities in the area; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
