Purpose & background

The purpose of this legislation is to amend the existing IGA with Trimet. The existing IGA is for Trimet to supply staffing services to PBOT for the SW Capitol Hwy project. The existing financial authorization ran into the not-to-exceed limit of $260,000 and needs to be extended another $60,000 for work completed through 6/30/22 when the staffing work terminated for this project. The IGA expires in 2024.

Financial impacts

This ordinance does not request any new funding. Funds are available within the existing project budget. The total project cost is $27.4 million, with cost shared between BES, PWB and PBOT. Total project cost for PBOT is $13.4 million which includes $6.6 million from Fixing Our Streets (FOS) $4.8 million from SDC, and $2 million from Oregon lottery funds. The original Trimet IGA is for $260,000. With this legislation, PBOT requests an amendment to the IGA for an additional $60,000, for a total authorization of $320,000. This estimate has been calculated through the end of 6/30/22 when IGA work ends. The original IGA requires that any amendment needs City Council approval, even to extend the authorization. The expenses and budget are tracked in project T00595, Capital Highway: Taylors Ferry – Garden Home, SW.

Community impacts

Failure to authorize additional funds will impact staffing and management of the construction contract. Public involvement is not necessary for internal staff management.

The City of Portland ordains: Section 1. The Council finds: In March of 2021, the City and Trimet entered into an agreement for Trimet to supply qualified staff to perform construction management services on the SW Capitol Highway Street Improvement Project in the amount not to exceed $260,000; Trimet and the City have agreed that staffing services for the SW Capitol Hwy project will be ending on June 30th, 2022; The City has determined that $60,000 of additional authorization is necessary to compensate for staffing services through June 30th, 2022 and that funding is available within the existing project budget T00595; Trimet and the City wish to amend the current agreement to pay for additional construction management staffing services for a total IGA amount not to exceed $320,000; The Bureau's level of confidence in the cost estimates for this project is high. NOW, THEREFORE, the Council directs: That the Commissioner-in-Charge is hereby authorized to amend the IGA with Trimet for additional staffing services for a total not-to-exceed amount of $320,000 in a form similar to Exhibit A. The Mayor and City Auditor are hereby authorized to pay for the contract from the existing budget in project T00595, Capital Highway: Taylors Ferry – Garden Home, SW. Section 2. The Council declares that an emergency exists because work is being performed and existing budget is available to pay for services in a timely manner ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
