The ordinance must be passed by Council to prepare the City for the new fiscal year on July 1, 2022. This item is included because ORS 221.770 requires the City to formally elect to accept state shared revenues.

Financial impacts

Conducting this hearing and subsequent resolutions make the City eligible for an estimated $22,775,856 in cigarette, liquor, and state marijuana taxes in FY 2022-23.

Community impacts

The City’s annual budget includes multiple programmatic changes that will impact the community. These programmatic changes invest resources and reallocate internal resources into bureau programs as articulated in the Approved Budget. A five-member Community Budget Advisory Board was invited to sit in on budget discussions with the Mayor and Council as the budget was developed. There were seven work sessions held to discuss the FY 2022-23 Budget process between March 7- 31, 2022. Council conducted two virtual listening sessions in April as well. Public comment has been solicited on the City Budget Office website, and in accordance with Oregon Local Budget Law, live public testimony was received on May 5th through a virtual community meeting and during the hearing held on May 11, 2022. Council members receive weekly emails from the CBO compiling the written comments received by the public through the online portal.

Full text (the legislation as adopted)

The City of Portland ordains: Section 1. The Council finds: The State of Oregon established a State Revenue Sharing Program through the enactment of Senate Bill 11 by the 1977 Oregon Legislative Assembly. Pursuant to ORS 221.770 the City must elect to receive the State Revenue Sharing Program funds and must notify the State of Oregon, Department of Administrative Services of said election. NOW, THEREFORE, the Council directs: The City Budget Office is hereby authorized to notify the State of Oregon, Department of Administrative Services that pursuant to ORS 221.770, the City hereby elects to receive State Revenue Sharing funds for FY 2022-23. The actions electing to receive State Revenue Sharing funds contained in this ordinance are binding City policy. Section 2. The Council declares that an emergency exists because the City is required to elect to receive State Revenue Sharing funds for FY 2022-23 before the start of the fiscal year on July 1, 2022; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
