Purpose & background

This contract is for the construction phase of contract (Ordinance No. 189217). The grant agreement with ODOT will provide safety improvements at the various project locations listed on Page 8 of the IGA listed under Exhibit A – Project Location and Scope of Work

Financial impacts

ODOT is delivering the project on ODOT and PBOT right-of-way, managing the project delivery and completion. The total project cost is estimated at $5,137,560 (low confidence estimate), which is subject to change. Federal funds for this project shall be limited to $4,669,864.07. The dollar amount was determined by the Cost Estimate provided by ODOT. The City of Portland shall be responsible for $62,068.09 towards project costs. This is a 7.78% match toward the Federal grant for the portion of work on PBOT facilities. This match was previously budgeted within Ordinance No. 189217. Costs for this project will be posted to PBOT Capital Project T00984, which is included in PBOT’s FY 2021-22 budget and five-year CIP forecast. No work outside this grant agreement is expected. There is no additional funding requested.

Community impacts

This grant will allow for brighter street lighting, new traffic signals, and in multiple locations within the City of Portland. These upgrades will result in safer street and crosswalks.

The City of Portland ordains: Section 1. The Council finds: In 2018 ODOT and PBOT entered into an agreement (Ordinance No. 189217) where ODOT would deliver scoped safety projects within PBOT right of way. In 2012, the federal transportation bill Moving Ahead for Progress in the 21st Century Act was signed into law, which increased transportation safety funding Utilizing this increased safety funding, the Oregon Department of Transportation created the All Roads Transportation Safety (ARTS) Program in 2013 to reduce fatal and serious injuries on all public roads through a data driven process, Portland Bureau of Transportation worked with the Oregon Department of Transportation to identify proven, low-cost measures that have successfully reduced the occurrence of fatal and serious injury crashes on Portland streets. ODOT and PBOT staff have developed a list of four projects on city streets that meet the criteria and available funds; Shown in Exhibit A – Project Location and Scope of Work: and ODOT has allocated $4,669,864.07 from the All Roads Transportation Safety (ARTS) program for these and related projects on ODOT facilities. PBOT has committed to a local match of $62,068.09 toward project costs. NOW, THEREFORE, the Council directs: The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $62,068.09 in a form similar to the contract attached as Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
