*Amend the 2021-2025 Consolidated Plan and the FY 2021-22 Action Plan to adopt and authorize submission of the HOME-American Rescue Plan to the US Department of Housing and Urban Development to apply and accept program funds totaling $13,567,782 (amend Ordinance No. 190467)

The City of Portland ordains: Section 1. The Council finds: The City of Portland by Ordinance No. 190467 adopted and authorized the submission of the 2021-2025 Consolidated Plan, and the FY 2021-2022 Action Plan application, for the Community Development Block Grant (CDBG), HOME Investment Partnership, Emergency Solutions Grant (ESG), and Housing Opportunities for Persons with AIDS Programs (HOPWA), to the U.S. Department of Housing and Urban Development. On April 8, 2021, the U.S. Department of Housing and Urban Development (HUD) announced the allocation of nearly $5 billion in American Rescue Plan (APR) funds to communities across the country through their HOME program. These HOME-ARP funds are intended to assist households experiencing homelessness and other vulnerable populations through the following eligible activities: Provide capital investment for permanent rental housing. Upgrade available stock of shelter to include Non-Congregate Shelter (NCS). Provide tenant-based rental assistance and supportive services. The Portland HOME Consortium has been allocated formula based HOME-ARP funds under this program and HUD has designated the City of Portland as the lead applicant for these funds. HUD has notified the City of Portland that the HOME Consortium has been allocated HOME-ARP funds totaling $13,567,782. As part of the ARP Act, HUD has suspended the HOME statutory match requirement and Community Housing Development Organization (CHDO) Set-Aside Requirement for the HOME-ARP. The HOME program regulations provide that jurisdictions may create a consortium for the purpose of receiving and administering their HOME grants. The City of Portland has formed a HOME Consortium with the City of Gresham and Multnomah County, Oregon, for this purpose each year since 1991. The City of Portland is the lead jurisdiction in the HOME Consortium. The City of Portland Ordinance No. 190490 provides the current authorization for HOME Consortium agreements for FY 2021-2022. In accordance with HUD notice titled Requirements for the Use of Funds in the HOME-American Rescue Plan Program (the Notice) , published on September 13, 2021, the City of Portland is required to apply for receipt of HOME-ARP funds through Substantial Amendment to its 2021-2022 Action Plan. According to the Notice, to receive its HOME-ARP funds, receiving jurisdictions such as the Portland HOME Consortium must engage in consultation and public participation processes and develop a HOME-ARP Allocation Plan that meets this program’s requirements and submit it to HUD as a substantial amendment to its Fiscal Year 2021 annual action plan. The City of Portland has complied with all HUD requirements to develop the Portland Home Consortium’s HOME-ARP Allocation Plan (the Plan) including the public notice and hearing requirements set forth in the Notice. Further, the Plan (See Exhibit A) includes all required elements like: Amount of amount of HOME-ARP funds the Consortium will receive Needs Assessment and Gaps Analysis Range of activities that the Consortium intends to undertake It is appropriate and in the public interest that the Mayor be authorized to apply for and receive the HOME-ARP funding allocation from HUD for the City of Portland and its HOME Consortium partners. NOW, THEREFORE, the Council directs: That the City adopt the Portland Consortium HOME-ARP Allocation Plan, a Substantial Amendment to the FY 2021-2022 Action Plan. The Mayor is authorized to apply to HUD on behalf of the City of Portland and its HOME Consortium partners for the HOME-ARP funds detailed in Section 1. The Mayor is authorized to provide such assurances and information to the Department of Housing and Urban Development as may be required for application and orderly management of the grants. This ordinance is binding City policy. Section 2. The Council declares that an emergency exists because the program funds must be obligated within required timeframes; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
