Authorize agreement with Clean and Safe, Inc. to provide policing services for the Clean and Safe Program

The City of Portland ordains: Section 1. The Council finds: Property owners within the Clean & Safe District enhanced service district, a 213-block area of downtown, pay a fee to fund supplemental services for neighborhood improvement, including cleaning, safety, and economic development. These supplemental services are managed by Clean & Safe, Inc., a non-profit group. Since 1997, Clean & Safe, Inc. and the City of Portland have engaged in contracts wherein the Portland Police Bureau provides services to Clean & Safe, Inc. in support of the Clean & Safe Program, officers patrolling the District on bicycles, with costs reimbursed by Clean & Safe, Inc. in accordance with the terms of the agreement. The most recent of these contracts was Contract No. 30002749, dated July 1, 2012, and extended for an additional five years beginning July 1, 2017. The current extended contract expires on June 30, 2022. In September 2021, Council passed Ordinance 190566, authorizing Contract No. 30007911, which includes an allowance for the continuance of the services funded by Contract No. 30002749. In recognition of the City Auditor report: “Enhanced Service Districts: City provides little oversight of privately funded public services”, Clean & Safe Inc.'s concerns over its funding of a basic service, and community concerns of police officer positions being funded by a private entity, both Clean & Safe, Inc. and the Portland Police Bureau wish to transition away from Clean & Safe, Inc.’s funding of Portland Police Bureau resources within the Clean & Safe District. Both Clean & Safe, Inc. and the Portland Police Bureau wish for an orderly transition to create the best opportunity for the Portland Police Bureau resources involved in the Clean & Safe Program to be maintained within the Clean & Safe District without Clean & Safe, Inc. monetary compensation. NOW, THEREFORE, the Council directs: That the Mayor be authorized to execute a new transitional agreement with Clean & Safe no longer than three years in term, in substantially the form attached to this Ordinance as Exhibit A, except for the reduction of the term mentioned in Section 4 of said form from 24 months to 12 months, and upon City Attorney approval of said form.
