*Accept and appropriate grant in the amount of $500,000 from Metro and authorize Intergovernmental Agreement for 82nd Ave planning and project development

The City of Portland ordains: Section 1. The Council finds: With direction from the State through HB 5006, the Portland Bureau of Transportation and the Oregon Department of Transportation are working toward a transfer of jurisdiction of 82 nd Avenue from NE Killingsworth Street to SE Clatsop Street. As part of the transfer agreement, PBOT will invest $185 million in state of good repair, safety and corridor investments. 82 nd Avenue is a high priority for safety and state of good repair investments. While funding for ODOT and the State will support planning, project development and construction of transportation projects, this funding may not be available for several months. In support of meeting the critical community need to begin investing in 82 nd Avenue, Metro has agreed to fund early work by the City of Portland on 82 nd Avenue. NOW, THEREFORE, The Council directs: The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from Metro for 82 nd Ave Planning and Project Development in the amount of $500,000 and to execute an Intergovernmental Agreement in a form similar to the contract attached as Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk. Any increases to the Grant Amount must be approved by City Council. FY 2021-2022 budget is hereby amended as follows: GRANTS FUND Fund: 217 Business Area- TR00 Bureau Program Expenses $500,000 The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf. Section 2. The Council declares that an emergency exists because delay would unnecessarily delay the City’s ability to perform the activities authorized in the IGA; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
