*Amend contract with Northwest Geotech, Inc. to increase amount by $300,000 to provide geotechnical engineering services for the Spectator Venues Program (amend Contract No. 31001984)

The City of Portland ordains: Section 1. The Council finds: The City’s Spectator Venues Program within the Office of Management and Finance (OMF) oversees the Veterans Memorial Coliseum (VMC), Rose Quarter Parking Facilities, Rose Quarter Plaza, Providence Park Stadium and the Portland’5 Centers for the Arts. As the property owner, the City has responsibilities to protect the public’s investments in these facilities and monitor all changes to the properties based on the terms of the agreements with the operators. As with all forms of infrastructure, Spectator Venues Program facilities have both foreseen and unforeseen maintenance demands that require the expertise of subject matter experts. Northwest Geotech, Inc. provides construction monitoring, special inspection and materials testing as well as geotechnical and environmental assistance to public and private entities throughout the Pacific Northwest. On-call Contract No. 31001984 was awarded to Northwest Geotech, Inc. for geotechnical engineering services through a direct COBID-certified firm contract (Certification Office for Business Inclusion and Diversity) on June 1, 2021 with a three-year contract term. Northwest Geotech, Inc. is a registered disadvantaged business enterprise (DBE) and minority business enterprise (MBE) in the State of Oregon. Escalating and increasingly urgent geotechnical engineering demands at Providence Park Stadium have produced the need for increased capacity greater than what is covered under the existing contract. This contract amendment adds capacity to allow for emerging and/or urgent geotechnical engineering needs at the City’s Spectator Venues Program facilities. The additional compensation authorized by this Ordinance is $300,000. The new not-to-exceed amount of the contract is $400,000, an amount believed to be sufficient to cover the City’s current and future anticipated demands. As it is an on-call contract, all work done will be subject to individual Task Orders. This amendment requires Council approval because it exceeds the PTE Manual maximum increase limit of 25% for direct contracts. Sufficient funding for this contract amendment resides in the Spectator Venues and Visitor Activities Fund 607000 in FY 2021-2022. NOW THEREFORE, the Council directs: The Chief Procurement Officer is hereby authorized to sign Amendment No. 1 to Contract No. 31001984 between the City and Northwest Geotech, Inc. for services in accordance with Exhibit A and attached hereto. The Mayor and Auditor are hereby authorized to draw and deliver checks payable to Northwest Geotech, Inc., chargeable to OMF when demand is presented and approved by the proper authorities. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the time-sensitive activities authorized by the contract; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
