Accept and appropriate grant in the amount of $9,351 and authorize Intergovernmental Agreement with Oregon Department of Transportation for the 2022 Motor Carrier Safety Assistance Plan for commercial motor vehicle inspections by Police Bureau sworn personnel

The City of Portland ordains: Section 1. The Council finds: The Oregon Department of Transportation (ODOT) has notified the City that it will award a grant for the 2022 Motor Carrier Safety Assistance Program (MCSAP) to the Police Bureau in the amount of $9,351.10; and The goal of MCSAP is to reduce accidents involving commercial motor vehicles (CMV) and to reduce injuries and fatalities resulting from accidents involving CMVs; and Police Bureau personnel trained and certified by ODOT as commercial vehicle inspectors pursuant to ORS 810.560 will initiate safety inspections only within the course of conducting valid traffic stops; and ODOT will reimburse the City a maximum of $9,351.10 for sworn personnel overtime hours worked on the 2022 Motor Carrier Safety Assistance Program during the grant period July 1, 2021 through September 30, 2022; and Local match in the amount of $1,648.90 shall be provided from the City in the form of Traffic Division salary and benefits for overtime hours in the Bureau’s FY 2021-2022 budget. Total project cost is $11,000 which includes Portland Police Bureau’s fourteen point ninety-nine (14.99) percent match NOW THEREFORE, the Council directs: The Mayor or Chief of Police is hereby authorized to accept on behalf of the City a grant from ODOT for the 2022 Motor Carrier Safety Assistance Program in the amount of $9,351.10 and to execute an Intergovernmental Agreement in a form similar to the Agreement attached as Exhibit A. The Mayor or the Chief of the Police Bureau is authorized to accept on behalf of the City any subsequent modifications by ODOT for the 2022 MCSAP grant program, ODOT Agreement # 73000-00004166, provided such modifications do not increase the City’s financial obligation or risk. Any modifications that increase the City of Portland’s financial obligation or risk must be authorized by Council. The FY 2021-2022 budget is hereby amended as follows: GRANTS FUND Fund - 217 Business Area - PL Bureau Program Expenses - $9,351.10 The Office of Management & Finance Grants Management Division is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Mayor’s behalf.
