Authorize a competitive solicitation and contract with the lowest responsible bidder for construction of the Errol Heights Park Development Project for an estimated cost of $7,060,000

The City of Portland ordains: Section 1. The Council finds: Portland Parks & Recreation (PP&R) promotes health, livability, and economic vitality through the effective management of the City’s award-winning parks and recreation system. Errol Heights Park, located between SE 45th and 52nd Avenues and between SE Harney Street and SE Tenino Drive, is a 16-acre park which includes a natural area, undeveloped park space, and a community garden. The Park is in the Brentwood-Darlington neighborhood, but also adjacent to both the Woodstock and Ardenwald/Johnson Creek neighborhoods. In 2005, PP&R completed a Master Plan for the property . The vision of Errol Heights Park Development Project (“Project”) is to be a place for both active play and for relaxing in a natural setting. The ‘upper’ topography of the park is planned as a more traditional recreation-oriented park, while the ‘lower’ portion of the property will have environmental enhancements and the accompanying trails and overlooks. In 2018, PP&R engaged the public to set community-supported priorities for the design and construction of park improvements , which comprise the current Project bid package. PP&R and its design consultants engaged the public through three Open Houses (both on-site and on-line) and seven Community Advisory Committee (CAC) meetings. The CAC was comprised of representatives from 13 neighborhoods representing a variety of recreational interests. The Project will include enhanced natural areas, new trails, amenities for play and sports, picnic and lawn areas, a Portland Loo and environmental observation areas. Funding for this Project is included in the 5-year Capital Budget beginning in FY 2021-22 through PP&R System Development Charges, with a total project budget of $12.7 million. The construction cost estimate for the Project provided by the consultant team led by Mayer Reed Landscape Architects and its cost estimator DCW Cost Management is $7.06 million. PP&R’s confidence level in the cost estimate is medium due to the current bidding and construction market, low contractor availability, and pricing risk from uncertainties in material supply chains for estimates and project bids. PP&R seeks Council’s authorization for Procurement Services to issue a competitive solicitation and execute a contract for the construction of the Project. NOW, THEREFORE, the Council directs: That the Chief Procurement Officer is authorized to facilitate the use of the competitive solicitation process to obtain the most responsible and responsive bid for the construction of the Errol Heights Park Development Project. Upon Council acceptance of the Chief Procurement Officer’s Report, Procurement Services is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney’s Office. The Mayor and Auditor are hereby authorized to draw and deliver checks chargeable to the PP&R System Development Charge funds when demand is presented and approved by the proper authorities.
