*Authorize Intergovernmental Agreement in the amount of $3,536,530 with TriMet for Central City in Motion and Rose Lane projects on SW 4th Avenue, SW Alder Street, and NE Couch Street

The City of Portland ordains: Section 1. The Council finds: The Portland Bureau of Transportation led a public planning process in coordination with TriMet to develop the Enhanced Transit Corridors and Central City in Motion plans; and These plans identified where transit priority treatments could be most beneficial on the planned TriMet Frequent Service network within the City of Portland. Such improvements can help make transit more attractive and reliable for people to get to work, school, and to meet their daily needs, especially for people who depend upon transit; and The ETC Plan was adopted by the Portland City Council in June 2018. The Central City in Motion plan was adopted by the Portland City Council in November of 2018; and Since adoption, PBOT, in coordination with TriMet, has be working to fund, design and implement identified projects that would benefit the greatest number of transit riders; and TriMet has agreed to reimburse the Portland Bureau of Transportation up to $ 3,536,530 for investments transit priority treatments on the SW 4 th Avenue Central City in Motion project and the Rose Lane projects on SW Alder and NE Couch; and NOW, THEREFORE, the Council directs: The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from TriMet for the construction of transit priority roadway treatments in the amount of $3,536,530. Any increases to the Grant Amount must be approved by the City Council. The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $3,536,530 in a form similar to the contract attached as Exhibit A. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf. Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
