Authorize Intergovernmental Agreement with Oregon Department of Transportation for reimbursement for Work Zone projects traffic enforcement

The City of Portland ordains: Section 1. The Council finds: State of Oregon Department of Transportation (ODOT) has granted funds biannually to the City for law enforcement in its highway work zones since at least 2003; The Portland Police Bureau (PPB) has used these grant funds to pay overtime costs associated with ODOT Work Zone traffic enforcement; Beginning with the 2021-2023 biennium, the process to provide Work Zone law enforcement on ODOT construction projects has changed. Law enforcement grant agreements and associated mini-grants are no longer being used to fund and track law enforcement on ODOT Work Zone construction projects; PPB Law enforcement in ODOT Work Zone projects will be implemented and billed on construction projects directly through the ODOT Project Delivery process using Intergovernmental Agreements (IGA); With the change in funding process, ODOT expects that Work Zone law enforcement will be able to be brought to work on a project more directly and as needed; and With this shift, there is no longer a “cap” on the amount of funding for enforcement that PPB may receive. The five-year IGA between ODOT and PPB for Fiscal Years 2021-2026 is set at a not-to-exceed value of $2,100,000; NOW, THEREFORE, the Council directs: That the Chief of Police is authorized to execute the Agreement between the City and State of Oregon Department of Transportation as outlined in a form similar to the Agreement attached as Exhibit A. The Chief of Police and the Project Manager are authorized to execute amendments to the scope of services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk.
