*Accept an Engineering Report on a proposed encroachment into the public right-of-way for a subsurface tunnel under SW Main St

The City of Portland ordains: Section 1. The Council finds: The Multnomah Athletic Club (MAC) and Ankrom Moisan Architects request approval of a subgrade tunnel encroachment beneath SW Main Street connecting a new Multifamily Housing development and shared use parking (the Housing Project) to the current parking garage operated by the MAC. The MAC will own, operate, and maintain the tunnel once construction is complete. The Housing Project will contain 334 units of housing. City Code encourages the shared use of permitted parking, which has led to the collaboration between the MAC and Housing Project. The tunnel will provide both vehicular and pedestrian access between the two blocks on either side of SW Main Street. The attached Engineer’s Report (Exhibit A) details specifications of the tunnel. The tunnel will be approximately 13 ½ feet high by 31 ½ feet wide by 70 feet long and will allow for two-way traffic and a dedicated pedestrian walkway. The City Engineer has reviewed the proposed encroachment into the public right-of-way and, subject to the MAC complying with certain conditions in the attached Engineer’s Report, has determined the use to be consistent with approval criteria and policies as outlined in the City Policy “Encroachments in the Public Right-of-Way”. NOW, THEREFORE, the Council directs: That the City Council accepts the Engineer’s Report attached as Exhibit A and incorporated by reference, to allow the MAC to construct a subsurface tunnel under a portion of SW Main Street upon conditions outlined in the Engineer’s Report. Section 2. The Council declares that an emergency exists because a delay in construction could cause an increase in construction costs and interfere with project timelines ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
