The City of Portland ordains: Section 1. The Council finds: The City, through the Portland Bureau of Transportation (PBOT), manages the public right-of-way to shape a livable city for all. The Culinary Corridor project encourages positive activation of the right of way by using food cart pods to bring local small businesses, community organizations and residents together. PBOT has partnered with Friends of the Greet Loop, Prosper Portland, and Portland Parks and Recreation to implement the Culinary Corridor: a project that seeks to create spaces for food carts in the Central City of Portland. Ankeny West is the first of three planned phases of the Culinary Corridor project and is located in the right of way between SW Park & SW 8th and W Burnside & SW Ankeny in the Central City. PBOT will close portions of streets adjacent to Ankeny West to accommodate for the food cart pod. These streets include SW Park Ave from W Burnside Street to SW Oak Street, SW Ankeny Street from SW Park Ave to SW 8 th Ave, and SW 8 th Ave from W Burnside to SW Ankeny Street. Electrical conduit will be run along portions of the right of way to provide power to the food carts. Lighting may also be strung along the street. Per Portland City Code (PCC) Chapter 17.60 Underground Wiring Districts , overhead wires and conduit on the street are prohibited in underground wiring districts in the City of Portland (PCC 17.60.020). This project occurs in District A of the Underground Wiring District. Approval of this ordinance would create a waiver to PCC 17.60.020 Overhead Wires Prohibited for electrical conduit and lighting across commercial streets adjacent to Ankeny West. NOW, THEREFORE, the Council directs: A waiver to City Code Section 17.60.020 be enacted to allow for the placement of electrical conduit and lighting in the right of way adjacent to Ankeny West subject to all reviews, approvals, and permits as required by the City of Portland. Section 2. The Council declares that an emergency exists because delay in this exemption may result in a delay in the Ankeny West project completion ; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
