*Amend City Code Police Review Board to delay certain requirements for citizen members of the Police Review Board  (amend Code Section 3.20.140)

The City of Portland ordains: Section 1. The Council finds: WHEREAS, on March 8, 2020, Oregon Governor, Kate Brown declared a State of Emergency in response to the increasing concern with COVID-19 (Coronavirus) within the state. The original State of Emergency has been extended and continues today; and WHEREAS, d ue to COVID-19, citizen members who serve on the Police Review Board have challenges in meeting all requirements for participation on the Police Review Board as delineated in Portland City Code Subsection 3.20.140 C.1.a(1)(b) , specifically participation in Bureau training and ride-alongs; and WHEREAS, i t is critical to the City that Police Review Board meetings occur in a timely manner due to the interest of the City in timely investigating complaints and due to the settlement agreement between the United States Department of Justice and the City of Portland; and WHEREAS, Police Review Board m eetings must include citizen members and due to COVID-19 there are insufficient citizen members for timely Police Review Board meetings with citizen members who meet all requirements. NOW, THEREFORE, the Council directs: Portland City Code Subsection 3.20.140 C.1.a(1)(b) shall be amended as follows: (b) All citizen members must meet at least the following qualifications to participate on the PRB Police Review Board, except that requirements (ii) and (iv) below may be delayed and citizen members may still participate on the Police Review Board during a State of Emergency declared by the President of the United States or the Governor of the State of Oregon or the Mayor or Council of the City of Portland, and requirements (ii) and (iv) shall be met as soon as reasonably practicable under the circumstances of the State of Emergency: (i) Pass a background check performed by the Bureau. (ii) Participate in Bureau training to become familiar with police training and policies. (iii) Sign a confidentiality agreement. (iv) Participate in ride alongs to maintain sufficient knowledge of police patrol procedures. Section 2. The Council declares that an emergency exists because delay would unnecessarily impact the City's timely investigation of complaints relating to sworn members of the Portland Police Bureau and compliance with the settlement agreement between the City and the United States; therefore, this ordinance shall be in full force and effect after its passage by the Council.
