The City of Portland ordains: Section 1. The Council finds: Portland Police Bureau (“PPB”)’s Air Support Unit (“ASU”) responds to mission requests on a callout basis. The ASU averages over 200 mission requests each year with nearly a quarter of those being requests that require an immediate response. To support ASU, PPB would like to execute two 12-month hangar lease agreements for storage of two Cessna aircraft from Jet Aero LLC (“Jet”) and a 5-year office sublease agreement for the associated office space from Lynx FBO Aurora LLC (“Lynx”). PPB previously had one Use and Occupancy Agreement with Atlantic Aviation for hangar and office space but ASU was notified to vacate the hangar space by May 31 st , 2021. The new site is serviced by Lynx and they have plans to build their own hangar in 2022 at which time ASU’s aircraft may be hangered in the new facility through an agreement to be co-terminus with the Lynx office sublease. In the interim, Lynx identified Jet as another private hangar that Lynx provides leasing services to where ASU’s aircraft could be hangered through May 2022. Resolution #37017, passed in 2013, “Reaffirming the City’s Interest to Maximize Investment in City-Owned Facilities by maintaining full occupancy and Directing the Office of Management and Finance to Fully Implement ADM 13.01”, directs OMF to work with bureaus to fully implement ADM 13.01 by bringing City operations back into City-owned facilities when possible. Due to the nature of the ASU’s use being specific to storage of aircraft and associated office support, there is no existing City-owned facility or property that could provide a viable option to accommodate the needs of the ASU. PPB has budgeted for rent payments funded by existing bureau General Fund appropriation. NOW, THEREFORE, the Council directs: The Chief Administrative Officer or designee is authorized to execute any documents including, but not limited to, amendments and extensions necessary to sublease or lease property for PPB’s Air Support Unit for aircraft storage and associated office space subject to commercially reasonable rental rates and terms consistent with other City agreements, vetted by OMF property management . All documents will be approved as to form by the City Attorney prior to execution.
